Indiana Legislature Updates Sentence Modification Statute

The current sentence modification statute requires the consent of the prosecutor if it has been more than 365 days since the Court imposed the sentence. However, the Indiana Legislature just passed a new law, which was signed by the governor, and the new law places discretion back into the hands of the trial courts. Therefore, the prosecutor’s consent will no longer be needed once the new law takes effect on July 1, 2014.
